GENERAL CONDITIONS

ARTICLE 1. PURPOSE

The purpose of these travel insurance and assistance agreements, which consists of the specific conditions, general conditions, and enrollment form information is to guarantee the insureds while they travel and during their vacation for a period not exceeding 90 consecutive days.

ARTICLE 2. DEFINITIONS

2.01 We, Us

2.02 Beneficiary / Insured
The physical person designated hereinafter, using the term "You".

2.03 Family members
Your spouse, common law spouse or partner by virtue of a PACS (pacte civil de solidarité), your or your spouse’s ascendants and descendants, your or your spouse’s step parents, brothers, sisters, step siblings and children-in-law.
They must reside in the same home country as you.

2.04 Relative or friend
Any individual whom you or one of your heirs may designate.
This individual must reside in the same country as you.

2.05 Residence
Your primary and habitual place of residence.
It must be located in a member country of the European Union or in Switzerland.

2.06 France
Metropolitan France, the Principality of Andorra or Monaco, and the Overseas Departments of France.

2.07 Foreign country
Any country other that your home country.
For the coverage of foreign medical costs, the French Overseas Territories are considered foreign countries by convention if your place of residence is located in France.

2.08 Trip
Vacation or rental reserved with Résid’Hôtel (including related services billed by Résid’Hôtel: ski lift fees, skiing lessons, and equipment rental) whose dates, destination, and cost are listed on the reservation form.

2.09 Territory
Coverage is effective throughout the world unless the agreement stipulates otherwise.

2.10 Accident
An abrupt change in one's condition caused by a sudden, unforeseeable, and violent outside event, beyond the control of the victim.

2.11 Illness
Sudden and unforeseeable change in one's condition certified by a proper medical authority.

2.12 Serious illness or accident
Accident or illness of an unforeseeable nature that may cause the victim's condition to worsen significantly within a short period of time unless appropriate care is provided promptly.

2.13 Medical staff
Structure adapted to each particular case, as decided by AXA Assistance evaluating physician.

2.14 Medical authority
Any duly licensed physician or surgeon in the country where the covered event occurs.

2.15 Hospitalization
Unexpected stay of more than 24 hours in a public or private healthcare facility, prescribed by a physician for medical treatment or surgery, subsequent to a serious illness or accident.

2.16 Damaged residence
Residence more than 50% damaged during your trip and rendered uninhabitable.

2.17 Deductible
Portion of damages payable by the insured.

2.18 Covered events
Serious illness or accident, death or any event requiring the intervention of AXA Assistance as provided for in the medical and emergency assistance plan.


ARTICLE 3. SUBSCRIPTION
Insurance must be taken out at the time that reservations for the trip are made.


ARTICLE 4. COMMENCEMENT AND DURATION OF COVERAGE

Only trips of up to 3 consecutive months are covered.
4.01 Medical assistance
Coverage takes effect on the starting date and automatically ends on the expiration date indicated on the enrollment form, except in the event of transporter delays and unless otherwise explicitly stipulated elsewhere in the policy.
In the event that you use a personal means of transportation is used to get from your residence to your vacation spot, coverage takes effect on the starting date and, at most, 48 hours before the starting date. It immediately ends on the expiration date and, at most, 48 hours after the expiration date.

4.02 Insurance coverage
Coverage for "Search and rescue costs", "Medical costs abroad", "Loss, theft, or deterioration of baggage", and "Trip interuption" takes effect on the starting or departure date and automatically ends on the date of return or the expiration date indicated on the enrollment form.
Coverage for "Trip cancellation" takes effect on the date that this policy is signed and autmatically ends at the time of check-out.
The starting (12 midnight) and ending (12 midnight) dates for vacation rentals are those indicated on the enrollment form.

ARTICLE 5. DEFINITION OF COVERAGE


TRIP CANCELLATION INSURANCE

5.01 Trip cancellation
    (1) Description and amounts
Coverage is provided for cancellation fees, for the amounts billed by the rental agency (upon complete cancellation of the rental) according to the chart that appears in the cancellation conditions established by Résid’Hôtel.

    (2) Limits
The insurer is responsible only for those cancellation fees owed on the date of the event leading to the application of coverage occurs, minus insurance premiums and closing costs (which shall be kept by Résid’Hôtel and not reimbursed under the terms of this policy).
The amount reimbursed may not exceed €4,000 per rental or trip and €20,000 for a single covered event.

    (3) Deductibles
A straight deductible of €30 per rental or trip is applicable unless otherwise provided for by contract.

    (4) Events covered
If you have taken out Travel Arrangement Protection Policy no. 080101901, only events 1 to 11 are guaranteed:

1) In the event of the serious bodily injury or death of:
-you, your spouse, common law spouse or partner by virtue of a PACS (pacte civil de solidarité), your ascendants and descendants, including those whom you do not claim as dependents, your step parents, brothers, sisters, step siblings and children-in-law, your legal guardian, whatever his or her country of residence may be, as well as any person who normallt resides with you;
-a handicapped person living under your roof.
-your professional substitute or person charged with the supervision of your minor children designated on the enrollment form (the name of only one professional substitute or child guardian may be designated on the enrollment form).

2) In the event of serious material damage to the place of residence or professional offices or agricultural operation of which you are the owner, tenant, or free occupant, destruction of more than 50% that necessitates your return or premises to the location in order to undertake the necessary preservation measures;

3) In the event of a state of depression or nervous or mental condition that requires hospitalization of more than four consecutive days;

4.) In the event of a mandatory administrative summons by an official instrument of an unforeseeable and undeferrrable nature for a date during your trip, provided that the date of the summons was not known on the date of your enrollment;

5) If you or your spouse are to be dismissed from your job on economic grounds, provided that proceedings were not already underway on the date that this policy was signed;

6) In the event of a notice to appear for the adoption of a child or to obtain a residency permit ou or for an organ transplant for a date during your trip, provided that the date of the summons or appointment was not known on the date of your enrollment;

7) In the event of a divorce or separation reigstered with the office of the court, provided that the date of registration is after the date that this policy was signed;

8) In the event of theft at your place of residence or professional offices or agricultural operation of which you are the owner, tenant, or free occupant, within 48 hours preceding your departure that necessitates your return or premises to the location in order to undertake the necessary preservation measures;

9) In the event of cancellation under the terms of this policy by one or more persons insured under the terms of this policy who are registered on the same enrollment form as you and where, owing to this cancellation, you are forced to travel alone or accompanied by one person;

10) If you decide to travel alone, insofar as the trip cancellation of the person who was to share the double hotel room reserved for your trip is covered under the terms of this policy, coverage shall be provided for any additional hotel fees that may arise from this cancellation up to the amount of the reimbursement that would be paid to you in the event of cancellation.

11) If you are unable to travel, or if you must transfer your trip to another person, reimbursement for the costs fo changing the name of the insured with the travel agency.
If you have taken out Snow Travel Arrangement Protection Policy no. 080102001, events 1 to 11 are covered, as is the following event 12:

12) In the event of insufficient or excessive snowfall which leads to the closing of more than 2/3 of the mechanical lifts that are normally in use at the site wher you are taking your vacation, for at least 2 consective days out of the 5 days preceding your departure, and only at:
- resorts located higher than 1,200 meters in altitude, between December 15 and April 15;
- or resorts located higher than 1,100 m that have a chair lift or gondola lift that transports skiers to a minimum altitide of 1,300 m, between December 15 and April 15.
The deductible in such cases is 5% of the amount of the compensation, with a minimum of €30 per rental.
    (5) Claims procedure
. You or one of your dependents must notify Résid’Hôtel of your cancellation upon the occurrence of the covered event that prevents your departure. Reimbursement paid by AXA Assistance is calculated using the cancellation fee schedule in effect on the date that the covered event is first verified.
. You must notify AXA Assistance within five business days following knowledge of the claim in accordance with the filing rpocedure described in Article 8, "General Conditions of Coverage".
. Your claim must contain the following information:
-first and last name and address
-policy number
-the specific reason for your cancellation (illness, accident, professional problem, etc.)
If the reason for the cancellation is illness or bodily injury, you or your dependents must also must also send the initial medical certificate specifying the date and nature of your illness or accident to the Medical Director of AXA Assistance in a confidential envelope within 10 days following the accident.
In the event of the closure of more than 2/3 of mechanical ski lifts, you must send us an official written statement specifying the rate of closure at the skiing area as well as the cause of the closure.
AXA Assistance will send the necessary forms to be completed to you or one of your dependents.
These must be returned completed to AXA Assistance witha copy of the policy and all documents requated to justify the reason for the cancellation and to evaluate the amount of the damage (enrollment form, original receipts of cancellation costs, original copies of the transportation documents).

    (6) Reimbursement
Reimbursement for cancellation costs is sent directly either to you one of your dependents, or in the event of a cancelled rental, to the bearer of the rental agreement or one of his or her dependents, to the exclusion of any other individual or legal entity.
Closing and visa costs and insurance premiums shall not be reimbursed.

    (7) Exclusions
Exclusions applicable to all coverage, listed in Article 6 of this policy, shall be in effect.
In addition, cancellations subsequent to one of the following circumstances or events are excluded:
. events that occur between the date that the trip is reserved and the date that this policy is signed;
. accidents or illnesses for which there has been a diagnosis, treatment, relapse, or hospitalization between the date that the trip is reserved and the date that this policy is signed;
. cancellations by the transporter or trip organizer, for any cause.
. a state of depression or nervous or mental condition that requires hospitalization of more than four consecutive days.
. elective abortions, and their results and complications.
. cosmetic surgery, cures, in vitro fertilizations.
. cancellations resulting from periodic monitoring and observation.
. cancellations caused by the non-presentation, for any reason whatsoever, of one of the documents necessary for the trip, except in the events stipulated in this policy.
. delays in obtaining a visa.


MEDICAL ASSISTANCE

5.02 Emergency medical evacuation
In the event of a serious accident or illness, the AXA Assistance medical staff shall contact the local attending physicians and decide on the steps best indicated in view of your condition, based on the information available and exclusively on medical considerations.

If the AXA Assistance medical staff recommends that you be repatriated, AXA Assistance shall arrange and pay for such transportation based exclusively on medical considerations deemed important to our medical staff.
Transportation may be to either:
. an appropriate healthcare facility nearby;
. a hospital facility in a neighboring country;
. the hospital facility closest to your residence in your home country.
In the event that you are hospitalized at a facility that is not part of your home country's hospital system, AXA Assistance shall, when the time comes, arrange your return after your condition is deemed by medical authorities to have stabilized and pay for your transportation to your residence in your home country.
Medical transportation can be by light ambulance, regular ambulance, train, scheduled flight or chartered air ambulance.
The AXA Assistance medical staff shall have sole authority to decide the location and date at which you are to be hospitalized, the need for an accompanying person and the method of transportation.
Any rejection of the solution proposed by AXA Assistance medical staff shall result in cancellation of individual assistance coverage.

5.03 Dispatch of a doctor onsite
If the circumstances require, the AXA Assistance medical staff may decide to send a doctor onsite in order to better determine and oversee what measures are to be taken.
AXA Assistance shall pay all travel and consultancy expenses for the doctor that they send.

5.04 Local accommodations
If the AXA Assistance meical staff decides to hospitalize you locally before your medical evacuation, AXA Assistance shall arrange and pay for the accommodations (hotel room, breakfast, and taxi) for the insured members of your family, for the duration of their stay with you, or for an unrelated insured person accompanying you.
AXA Assistance shall pay up to €60 per day per insured for a maximum of 10 consecutive days, for the duration of the hospital stay.
This coverage is not cumulative with 5.06 "Visit of a relative of friend".

5.05 Trip extension
In the event that the AXA Assistance recommend an extended trip, AXA Assistance shall arrange and pay for the accommodations (hotel room, breakfast, and taxi) for the insured members of your family, for the duration of their stay with you, or for an unrelated insured person accompanying you.
AXA Assistance shall pay up to €60 per day per insured for a maximum of 10 consecutive days, for the duration of the hospital stay.
This coverage is not cumulative with 5.06 "Visit of a relative of friend".

5.06 Visit of a relative of friend
If your health does not allow for or necessitate your medical evacuation and you are hospitalized for more than three consecutive days (on the first day of hospitalization, in the event of a life-threatening condition or if the insured is a minor or handicapped), AXA Assistance shall pay for round-trip transportation for one member of your family or one relative or friend to visit you. This benefit is only available in the event that no adult member of your family is present locally (one transportation document for each parent, father and mother, sfor a minor).
AXA Assistance shall arrange and pay for the accommodations (hotel room, breakfast, and taxi) for the insured members of your family, for the duration of their stay with you, or for an unrelated insured person accompanying you.
AXA Assistance shall pay up to €60 per day per insured for a maximum of 10 consecutive days, for the duration of the hospital stay.
This benefit is only available in the event that no adult member of your family is present locally. This coverage is not cumulative with 5.04 "Local accommodations" and 5.05 "Trip extension".

5.07 Repatriation in the event of death
AXA Assistance shall arrange and pay for the return of the Insured's mortal remains, from the place of death to the place of burial in the home country, as well as the mortician's fees and expenses, placement in a casket and procedures required for transportation.
Casket costs incurred in connection with transportation shall be limited to €1,500.
The Insured's family shall be responsible for all funeral, local transportation, and burial or cremation expenses.
AXA Assistance may contract for transportation with service providers at our discretion.

5.08 Accompaniment of the deceased
If the epresence onsite of a friend or family member of the insured deceased is indispensable for the recognition of the body and repatriation or cremation formailities, AXA Assistance shall arrange and pay for a return trip ticket and any travel expenses (hotel room, breakfast, and taxi) incurred by this person.
AXA Assistance shall pay up to €60 per day per insured for a maximum of 4 consecutive days;
This coverage may be implemented only if the insured was traveling alone at the time of his or her death.

5.09 Return of insured minors
Following the serious bodily injury or death of an insured and in the absence of an adult family member to watch over the remaining children unsupervised on site, AXA Assistance shall arange and pay for their trip home.
The accompaniment of these children shall be made by a family member or friend duly designated and authorized by the family of the insured or one of his or her dependents, or, failing these, by qualified personnel.
AXA Assistance shall arrange and pay for a return trip ticket for this accompanying adult and any travel expenses (hotel room, breakfast, and taxi) incurred by this person.
AXA Assistance shall pay up to €60 per day for a maximum of 4 consecutive days.

5.10 Repatriation of insureds
In the event of a serious accident or illness, or death, AXA Assistance shall organize and pay for the return home of your close relatives or an individual who is not related to you but is also an Insured and who resides in the same country as you.
AXA Assistance shall pay for a one-way economy class airplane ticket or first-class train ticket, provided that the transportation originally scheduled for their return trip is not useable or modifiable.
Exclusion from medical assistance coverage
Exclusions applicable to all coverage, listed in Article 6 of this policy, shall be in effect.
In addition, the following are excluded from coverage:
. Benign health problems or injuries which can be treated on the spot and do not prevent you from continuing your trip;
. Convalescence or conditions for which you are being treated and/or which require prescribed subsequent treatment;
. Preexisting illnesses diagnosed and/or treated, in the absence of complications or unforeseeable serious aggravation;
. Pregnancies, in the absence of unforeseeable complications, and in any event pregnancies beyond the 28th week of amenorrhea;
. Childbirth, caesarian and post-natal child care;
. Elective and therapeutic abortions;
. Trips taken for the purpose of diagnosis and/or treatment, physical examinations, check-ups, or medical examinations of a preventive nature;
. The practice of aerial, self-defense and combat sports in an amateur capacity;
. The consequences of the absence or impossibility of vaccination.


MEDICAL EXPENSES

5.11 Medical expenses abroad
    (1) Purpose
AXA Assistance will reimburse you for expenses incurred for medical and surgical procedures prescribed by any medical authority subsequent to an accident having occurred abroad during your trip.

Covered expenses:
Visit and consultation fees, nursing costs, hospitalization and surgery, including physicians' and surgeons' fees and, in general, any medical or surgical procedure during your hospitalization related to your condition.

Coverage is subject ot the following conditions:
. Your hospitalization must be arranged by or in agreement with AXA Assistance medical staff. This agreement becomes effective when you or a person acting on your behalf receives a case number;
. In the event that you are hospitalized, except in cases of force majeure, AXA Assistance must be informed of your hospitalization within 24 hours after the date stated on the certificate of hospitalization;
. You must agree to be transferred to any hospital facility recommended by AXA Assistance medical staff;
. In all circumstances, the physician assigned by AXA Assistance must be able to see you and must have free access to your medical records, subject to strict compliance with medical secrecy rules;
. Benefits automatically end on the date that AXA Assistance arranges your evacuation.

    (2) Limits
The amount of coverage by AXA Assisitance per Insured and per trip is limited to the amount of €7,000; emergency medical costs are in all cases limited to €153.
In all cases, a deductible of €30 per case is applicable.
AXA Assistance shall intervene only in addition to the coverage offered by any individual or group health and/or other coverage insuance policy that you have.

    (3) Conditions of coverage
If you are covered under French Social Security, AXA Assistance recommends that you obtain a European Health Insurance Card from your Social Security office in order to be entitled to Social Security coverage during travel in a member country of the European Union.
Documents required in support of claims
3.1 If you have paid for your hospitalization, you must send AXA Assistance the following information and documents:
-The nature, circumstances, date and place of the accident that caused hospitalization expenses to be incurred locally;
-A copy of the prescriptions issued to you;
-A copy of the bills for all medical expenses paid;
-The reimbursement reports and/or statements for any other insurance plan making payments;
-The original reimbursement forms for any other French and/or foreign insurance plan that covers your medical expenses, including their name, the address of the administrator, and the policy and case numbers;
-In the event of an accident, the name and address of the person responsible and, if possible, of witnesses, indicating whether an official report was made by the law enforcement authorities;
-In general, any documents making it possible to accurately evaluate the remaining expenses that you are expected to incur;
-In addition, you must send to the AXA Assistance Medical Director, in an envelope marked “confidential”, the initial medical certificate stating the nature of the accident and any other certificate AXA Assistance may request.

In the event that the medical plans under which you are covered fail to pay for hospitalization expenses incurred, AXA Assistance shall reimburse such expenses up to the stated limit, provided that you send us:
. the original invoices for medical treatment and surgery;
. the statement issued by your medical plan denying coverage.

3.2 AXA Assistance advances funds by paying for your hospitalization on the following conditions:
-AXA Assistance can make the advance only if you have purchased coverage and your hospitalization has been determined to be necessary by its medical staff;
-AXA Assistance pays for your hospitalization directly to the hospital facility;
-In order to protect our rights, we reserve the right to request that you or your dependents provide either an imprint of your bank card, a security deposit check, or a written receipt for the amount of the advance;
-AXA Assistance will send you requests for the reimbursement of advances of hospitalization expenses with supporting documents;
-AXA Assistance shall intervene only in addition to the coverage offered by any individual or group health and/or other coverage insuance policy that you have.
-You must complete, as quickly as possible, all formalities aimed at obtaining compensation for expenses under your existing additional individual or group medical plan and/or pursuant to their insurance policy to obtain coverage from them.
-You must send AXA Assistance a check made out to AXA Assistance, in repayment of funds advanced to you.
-In the event that you are denied coverage under your medical plan, you must send AXA Assistance the notice of denial of coverage accompanied by the original bills. AXA Assistance will pay the portion of the expenses not reimbursed by your medical plan.
-If you fail to provide AXA Assistance with the original reimbursement form or, if applicable, a notice of denial of coverage, you shall owe AXA Assistance the full amount advanced by AXA Assistance and must repay it in its entirety within 60 days of the date on which AXA Assistance sent you the reimbursement requests. This obligation also applies if you initiated claim procedures with the social security system under which you are covered.

    (4) Payment of hospitalization expenses
AXA Assistance will pay up to 100% of actual hospitalization expenses payable by you, within the stated limit, not including the deductible set out in the policy schedule, in excess of expenses of the same nature paid by the hospitalization plan under which you are covered, as ratably allocated to each insurer.

    (5) Exclusions
Exclusions applicable to all coverage, as stated in Article 6 of this policy, shall be in effect.
In addition, no advances, reimbursements, or compensation shall be paid for:
• Expenses incurred in the Insured's home country;
• Expenses incurred in the Overseas Departments for Insureds residing in metropolitan France or Monaco;
• Expenses incurred in metropolitan France or Monaco for Insureds residing in the Overseas Departments;
• Vaccinations, physical examinations, check-ups, and medical examinations of a preventive nature;
• Expenses incurred due to a preexisting illness diagnosed and/or treated before departure or caused by an accident before departure, unless due to a serious and unforeseeable complication or aggravation;
• Convalescence or health problems for which you are being treated and/or which require previously prescribed medical attention;
• Orthotics and prosthetics, glasses and contact lenses;
• Contraception and fertility treatment;
• Expenses incurred due to pregnancies, in the absence of unforeseeable complications, and in any event pregnancies beyond the 28th week of amenorrhea;
• Childbirth and post-natal child care;
• Elective abortion, amniocentesis;
• Cosmetic treatment and surgery, not due to an accident;
• Treatment in health spas, convalescent homes, and rehabilitation facilities;
• Expenses resulting from the practice of aerial, self-defense, or combat sports in an amateur capacity;
• Expenses incurred during trips taken for the purpose of diagnosis and/or treatment.


SEARCH AND RESCUE COVERAGE

5.12 Search and rescue costs

    (1) Definition and amounts
You are covered for the reimbursement of any search and resue costs made necessary by the involvement, on private or public land, of teams belonging to duly approved and properly equipped companies, in your location and evacuation to the nearest medical care facility.

    (2) Limits
Coverage is limited to €770 per insired per trip, with a maximum of €3,800 perevent, regardless of the number of insureds involved.
Coverage is effective in addition to or after the exhaustion of any similar additional coverage that you may have.

    (3) Claims procedure
You or any person acting on your behalf must notify AXA Assistance within five business days following the end date of your trip in accordance with the filing procedure described in Article 8, "General Conditions of Coverage".
Your claim must include the following information:
-your first and last name and address
-membership number
-policy number
-date, causes, and circumstances of the accident
-original supporting documents.

    (4) Exclusions
Exclusions applicable to all coverage, listed in Article 6 of this policy, shall be in effect.


TRAVEL ASSISTANCE COVERAGE

5.13 Medical information and advice
The AXA Assistance medical staff shall be available for medical information and advice of a general nature 24 hours a day, 7 days a week.
. Regarding one or more medications:
-generic
-secondary effects
-contraindications
-interactions with other medications.
. In the following areas:
-vaccinations
-dietetics
-life hygiene
-alimentation
-travel preparation.

The medical staff shall be limited to giving objective information.
The purpose of the service is not to give a personalized medical consultation over the telephone or to facilitate self-medication. For such requests, AXA Assistance will advise you to consult your attending physician.

5.14 Early return
Should an unforeseen event occur during your trip that requires a premature return to your residence, AXA Assistance shall arrange and pay for one of the following services:
. your return trip and those of your insured family members or unrelated insured person accompanying you;
. or your round-trip. The following unforeseen events are covered:
. serious bodily injury of a life-threatening nature (in the opinion of the AXA Assistance medical staff) or death of:
-your spouse, common law spouse or partner by virtue of a PACS (pacte civil de solidarité), your ascendants and descendants, step parents, brothers, sisters residing in your country of residence;
. unforeseen hospitalization of a minor living with you;
. the death of one of the following persons: step siblings and children-in-law, residing in your country of residence;
. serious material damage that absolutely requires your presence to complete the necessary formalities on the premises where the following are located:
- your primary residence;
- your agricultural operation;
- your professional offices.

5.15 Loss or theft of documents or personal effects
During your travel abroad, in the event of the loss or theft of your identity documents, means of payment, or transportation documents, after filing a report with the local competent authorities, AXA Assistance shall provide the following services:
During your trip

    (1) AXA Assistance shall advise you on what administrative procedures to complete;
    (2) AXA Assistance shall cancel your means of payment subject to your faxed approval;
    (3) In the event that replacement documents can be made available in your country of residence, AXA Assistance shall get them to you by the quickest means possible;
    (4) In the event of baggage theft, upon your request, AXA Assistance shall give you an advance to allow you to make necessary emergency purchases, of up to €770 per event;
    (5) In the event of the loss or theft of transportation documents, AXA Assistance shall provide you with a new, non-negotiable ticket as part of an advance;
You undertake to repay any amounts advanced under the terms and conditions described in Article 8 of this policy, "General Conditions of Coverage".

5.16 Urgent message relay
If it is materially impossible for you to send an urgent message, upon your request, AXA Assistance shall send any message that you wish to your family members, friends, or employer at no cost, by the fastest means possible.
AXA Assistance may also relay messages from these parties to you.
The messages remain your sole responsibility; AXA Assistance plays only an intermediary role in their transmission.



TRAVEL INTERRUPTION INSURANCE

5.17 Travel interruption
    (1) Definition
The purpose of this coverage is to provide compensation for you, your family members or an unrelated person accompanying you designated on the enrollment form for the material damages resulting from the interruption of your trip subsequent to one of the events hereinafter defined that occur during the trip.
You shall be compensated if AXA Assistance staff intervened on your behalf in any of the events defined in paragraph 3 of this coverage.

    (2) Limits
You shall be compensated for land services purchased at the Résid’Hôtel reservation center and not used because your trip was interrupted (rental costs, fees, skiing lessons, equipment rental).
This compensation is calculated starting on the day following the complete discharge of the insured services and is proportional to the number of unused days on the trip.
You shall be compensated for a maximum of €3,000 per rental and €18,000 per event.

    (3) Covered events
Coverage is given exclusively in the event that one of the following events occurs during the length of the stay (once you have taken possession of your accommodations) recorded on the enrolment form:
. Emergency medical evacuation,
• Serious bodily injury of a life-threatening nature (in the opinion of the AXA Assistance medical staff) or death of:
-your spouse, common law spouse or partner by virtue of a PACS (pacte civil de solidarité), your ascendants and descendants, step parents, brothers, sisters residing in your country of residence;
• Unforeseen hospitalization of a minor living with you;
• The death of one of the following persons: step siblings and children-in-law, residing in your country of residence;
• Serious material damage that absolutely requires your presence to complete the necessary formalities on the premises where the following are located:
- your primary residence;
- your agricultural operation;
- your professional offices.

    (4) Claims procedure:
. Within five business days following the end date of your trip, you or one of your dependents must send AXA Assistance your travel interruption claim form and the reasons justifying it in accordance with the filing procedure described in Article 8, "General Conditions of Coverage".
. Your claim must include the following information:
- your first and last name and address
- policy number
- the speciific reason behind your interruption
- the initial medical certificate specifying the date and nature of the serious bodily injury sent to the AXA Assistance Medical Director in an envelope marked “confidential”, or as the case may be, the death certificate, the police report, expert report, or summons.
You or one of your dependents must then send the following to AXA Assistance, either directly or through your travel agent:
-The original initial invoice issued during the reservation.

    (5) Exclusions
Exclusions applicable to all coverage, listed in Article 6 of this policy, shall be in effect.

ARTICLE 6. EXCLUSIONS APPLICABLE TO ALL COVERAGE

Benefits shall not extend to the following events or consequences thereof, for which no compensation whatsoever shall be paid:
• Alcohol abuse (alcohol level above the legal limit), or the use or abuse of non-prescribed medication, narcotics, or drugs;
• Willful or fraudulent acts on your part;
• Participation in a competitive sport or rally affording national or international ranking, organized by a licensing sports association, as well as training for such competitions;
• The practice of any sport in a professional capacity;
• The consequences of non-compliance with normal safety measures associated with the practice of any sport or recreational activity;
• Voluntary non-compliance with the laws of the country visited or the practice of activities not authorized by local authorities;
• Official prohibitions, confiscations or restrictions by law enforcement agencies;
• Civil or foreign war, riots or civil commotion, lock-outs, strikes, bombings, terrorist acts or attacks, hijacking, storms, hurricanes, earthquakes, windstorms, volcanic eruptions or other natural disasters, nuclear accidents, explosions of radioactive devices, and the effects thereof,
• Epidemics, the effects of pollution and natural disasters, as well as their consequences.


ARTICLE 7. RESTRICTIVE CONDITIONS

7.01 Liability
AXA Assistance shall not accept liability for:
• any loss of a business or commercial nature you incurred as a result of an accident that required the intervention of AXA Assistance.
• the consequences of any delays, failure, or negligence by the subcontracting service provider. AXA Assistance cannot take the place of local or national emergency assistance or search services and shall not cover any costs attributable to their performance unless otherwise provided for by contract.

7.02 Special situations
AXA Assistance undertake to use every resource at our disposal to provide all of the benefits set out in this policy.

However, the parties agree that AXA Assistance has an obligation to use its best efforts and not an obligation to produce a specific result, given the circumstances in which AXA Assistance may be required to perform its services.
Accordingly, we shall not be liable for any non-performance or delay due to declared or undeclared civil or foreign war, general mobilization, requisition of persons or property by the authorities, terrorist acts or sabotage, labor disputes and strikes, riots, civil unrest, restrictions on the free circulation of goods and persons regardless of the authority enforcing such restrictions, natural disasters, the effect of radioactivity, epidemics, biological or chemical risks, or any event of force majeure preventing this policy from being performed.

ARTICLE 8. GENERAL CONDITIONS OF COVERAGE

8.01 For medical and emergency assistance

    (1) Prior approval
You must obtain the prior approval of AXA Assistance before taking any action and/or incurring any expenses. After prior approval is granted, you receive a case number entitling you to benefits under this policy and to the reimbursement of your expenses.

    (2) Coverage shall operate as follows:
• AXA Assistance shall perform services within the framework stipulated by national and international rules and regulations.
• You must follow the course of action that AXA Assistance advocates.
• AXA Assistance reserves the right, before performing any services, to verify the actual situation of the event covered and the merits of your request.

    (3) Procedure for requesting assistance

    (4) Provision of transportation
If AXA Assistance arranges and pays for transportation under this policy, you must agree to either:
• Let AXA Assistance use any ticket not used by you;
• Or repay to AXA Assistance any amount refunded by the issuer of the ticket.
AXA Assistance shallarrange and pay for either:
• Economy-class airfare;
• Or first-class train fare.

    (5) Lodging costs
Lodging costs paid under the tems of this policy must be substantiated with a bill issued by the hotel.
Compensation may not be received for any other temporary lodging solution.

    (6) Procedure for reimbursement of expenses incurred under assistance coverage.
Expenses are reimbursed solely upon submission of original invoices or receipts accompanied by the case number evidencing the prior authorization of AXA Assistance.

8.02 For insurance coverage
Claims procedure for insurance coverage
Under penalty of forfeiture, except in any event of force majeure, you must notify the AXA Assistance Payment Management Department and file your claim with any supporting documentation within five business days following the end of your travels.
For cancellation insurane coverage, you or your dependents must notify Résid’Hôtel of your cancellation when the covered event that prevents your departure occurs and notify AXA Assistance within five business days of knowledge of the event.

After this period, if AXA Assistance suffers any damages because of your late claim, you shall lose all right to compensation.
. Any claim that does not conform to the stipulations of the insurance policy shall lead to the forfeiture of any right to compensation.
. If necessary, the claim manager has the right to subject you, at his or her expense, to medical supervision by registered letter with acknowledgement of receipt.
. AXA Assistance has the option, if necessary, to request firther documentation.

8.03 Advances
-Should you request an advance of funds during your stay in a foreign country, as provided for under this policy, AXA Assistance may either:
• Pay your expenses directly;
• Or provide the amount of the advance in the local currency.
Advances are for actual expenses, limited to the amount indicated in the policy schedule.
-In order to protect its rights, AXA Assistance reserves the right to request, prior to any advance, a financial guarantee for the amount of the advance by either:
• A charge to your bank card;
• An imprint of your bank card;
• A security deposit check;
• Or a written receipt of the advance.
-If the account associated with your bank card is not debited by AXA Assistance for the amount of the advance you receive, you have 30 days (60 days for advances for "medical expenses") to reimburse the amount due.
After this period, AXA Assistance reserves the right to take all necessary measures to collect the amount due, and AXA Assistance may charge interest on the amount claimed, at the rate in effect.


ARTICLE 9. LEGAL PROVISIONS

9.01 Act on Computerized Data and Civil Liberties
Telephone conversations between the Insureds and AXA Assistance* may be recorded for the purpose of monitoring the quality of the services provided.
Pursuant to Articles 32 et seq. of Law no. 78-17 of January 6, 1978, on Computerized Data and Civil Liberties (as amended), Insureds are hereby advised that the personal information they are asked to provide when they phone is necessary to process their requests.
Failure to provide that information will cause them to lose their benefits under the Policy.
Insureds are entitled to have access to all information concerning them and to correct same at AXA Assistance, as well as persons responsible for the preparation, management, adn execution of the policy, within the limits of their respective contributions.
Consequently, data may be transferred to the country in which the insured is located at the time of his or her demand.
The insured has the right to acces and correct the data concerning him or her, by writing to AXA Assistance* Legal Department, 6 rue André Gide - 92320 Châtillon.

9.02 Subrogation
AXA Assistance is subrogated to the rights and actions of all individuals and legal entities covered by all or part of the medical and emergency assistance insurance provided under this policy, in claims against third parties liable for events which required the intervention of AXA Assistance, up to the limit of the expenses it incurs in the performance of this policy.

9.03 Statute of limitations
Any claim under this policy shall be time-barred two years following the date of the event out of which the claim arose..

9.04 Settlement of disputes
Any dispute arising out of this policy that cannot be settled independently by the Parties shall be referred to the court with jurisdiction in accordance with Articles L114-1 and L114-2 of the French Insurance Code.
